Refund policy

This Returns, Refunds & Consumer Guarantees Policy applies to purchases made through leabart.com.

Leabart is operated by Taitoa Group LLC trading as Leabart.

Nothing in this policy is intended to exclude, restrict or modify any rights or remedies you may have under the Australian Consumer Law (ACL) or any other applicable law where those rights cannot lawfully be excluded.

14-Day Change-of-Mind Returns

In addition to your rights under the Australian Consumer Law, Leabart offers a 14-day change-of-mind return period.

You may request a return within 14 days of receiving your order.

To be eligible for a change-of-mind return, the item must:

  • Be unused and unworn, other than being tried on for fit;

  • Be in its original condition;

  • Have all original tags attached, where applicable;

  • Be returned with its original packaging, where reasonably possible; and

  • Be accompanied by proof of purchase.

Items showing signs of wear, damage, alteration or use beyond what is reasonably necessary to inspect or try the product may not qualify for a change-of-mind return.

To request a return, contact us at info@leabart.com and include your order number and the item or items you wish to return.

For example:

“Hi, I would like to return order #12345.”

Please contact us before sending your return so that we can provide the correct return address and any order-specific return instructions.

Do not send returns to our business address unless we specifically instruct you to do so.

There is no fixed time limit that applies to every product under the consumer guarantees. The period for which a product can reasonably be expected to meet the consumer guarantees depends on factors including the nature of the product, its price, how it was represented and how it would reasonably be expected to be used.

Faulty, Damaged, Incorrect or Misdescribed Items

Please inspect your order as soon as reasonably possible after delivery.

Contact us at info@leabart.com if:

  • Your item arrives damaged;

  • Your item is faulty;

  • You receive the wrong item;

  • The item is materially different from its description; or

  • There is another problem that may mean the product does not meet the consumer guarantees under the Australian Consumer Law.

When contacting us, please provide:

  • Your order number;

  • A description of the problem; and

  • Clear photographs or video of the item, packaging and shipping label where reasonably relevant.

Providing photos or video can help us assess the issue more quickly, but doing so does not remove or limit any rights you may have under the Australian Consumer Law.

Please do not dispose of a faulty, damaged or incorrect item until we have had a reasonable opportunity to assess the issue and provide instructions.

Major Problems

If a product has a major problem under the Australian Consumer Law, you may be entitled to choose between:

  • A refund; or

  • A replacement of the same type of product.

A problem may be considered major where, for example:

  • A reasonable consumer would not have purchased the product if they had known about the problem;

  • The product is substantially unfit for its normal purpose and cannot easily be fixed within a reasonable time;

  • The product is substantially unfit for a purpose you specifically told us about and cannot easily be fixed within a reasonable time;

  • The product is significantly different from its description, sample or demonstration model; or

  • The product is unsafe.

Where Australian Consumer Law requires a full refund for a major problem, the refund will be for the amount paid for the affected product.

Minor Problems

If the problem is not major, we may generally choose to provide an appropriate remedy, such as a repair, replacement or another solution permitted by the Australian Consumer Law.

If we cannot remedy the problem within a reasonable time, you may have additional rights under the Australian Consumer Law.

Return Shipping

Change-of-Mind Returns

For returns made under our voluntary 14-day change-of-mind policy, you are responsible for the cost of returning the item to us unless we tell you otherwise.

Original shipping charges are generally not refundable for a change-of-mind return unless required by applicable law.

We strongly recommend using a tracked shipping service and keeping proof of postage until your return has been processed.

You are responsible for packaging the return appropriately and following the return instructions we provide.

Faulty or Non-Compliant Products

Different rules apply where an item does not meet the consumer guarantees under the Australian Consumer Law.

If we confirm that an item has a problem covered by the Australian Consumer Law, we will reimburse reasonable return postage costs where required by law.

Please contact us before returning a faulty item so that we can provide appropriate instructions.

International Fulfilment and Return Addresses

Some Leabart products may be shipped through international fulfilment partners.

As a result, the correct return address may differ depending on the product and order.

Do not automatically return an item to the address shown on the original parcel or to our business address.

Contact info@leabart.com before sending your return so that we can provide the appropriate return address.

The use of international fulfilment partners does not reduce or exclude any rights Australian consumers may have under the Australian Consumer Law.

Exceptions to Change-of-Mind Returns

Our voluntary change-of-mind return policy may not apply to:

  • Personalised, customised or made-to-order products;

  • Products clearly marked as final sale before purchase, where permitted by law;

  • Sealed hygiene-sensitive products where the seal has been broken after delivery and the product cannot reasonably be resold for health or hygiene reasons;

  • Gift cards; and

  • Any other product specifically identified as ineligible for change-of-mind returns before purchase.

These exclusions apply only to our voluntary change-of-mind policy.

They do not exclude or restrict any remedy you may be entitled to under the Australian Consumer Law if a product is faulty, unsafe, misdescribed or otherwise fails to meet a consumer guarantee.

Sale and Discounted Items

Sale, promotional and discounted items remain protected by the Australian Consumer Law.

A reduced price does not remove your rights if a product is faulty or otherwise fails to meet the consumer guarantees.

Unless an item is clearly identified as excluded from our voluntary change-of-mind policy before purchase, sale and discounted items may also be returned under our standard 14-day change-of-mind policy.

However, you will generally not be entitled to a remedy for a defect that was specifically disclosed to you before purchase and was the reason the item was discounted.

Exchanges

We do not currently offer direct exchanges.

If you would like a different size, colour or product, you may return the original item in accordance with this policy and place a new order separately.

Your rights under the Australian Consumer Law remain unaffected.

Refunds

Once we receive and inspect an eligible change-of-mind return, we will notify you whether the refund has been approved.

Approved refunds will be issued to the original payment method.

We aim to process approved change-of-mind refunds within 10 business days of receiving and inspecting the returned item.

Your bank, credit card issuer or payment provider may require additional time to make the funds available after we issue the refund.

If you believe a refund has not appeared within a reasonable time after we have confirmed that it was issued, contact us at info@leabart.com.

Refunds and remedies required under the Australian Consumer Law will be provided in accordance with your statutory rights and are not limited by our voluntary change-of-mind return procedures.

Where a full refund is required under the Australian Consumer Law, it will generally be provided using the original method of payment unless you agree to another method.

Lost Packages

If tracking information suggests that your package has been lost in transit, contact us at info@leabart.com with your order number.

We may ask for additional information so that we can investigate the shipment with the carrier and fulfilment partner.

Where we determine that an order has been lost before delivery, we will provide an appropriate remedy, which may include replacement or refund depending on the circumstances and your rights under applicable law.

Proof of Purchase

We may request reasonable proof of purchase when processing a return, refund or consumer guarantee claim.

Proof of purchase may include:

  • Your Leabart order confirmation;

  • A receipt;

  • A payment record; or

  • Another reasonable record showing that the product was purchased from Leabart.

A faulty product does not need to be in its original packaging in order for you to exercise rights available under the Australian Consumer Law.
